Restaurant and Retail Sales - Use of Outside Designated Areas


In response to the State’s social distancing regulations proposed for the reopening of restaurants and retail sales during the current Covid-19 pandemic, the Windham Town Council, working with the Planning and Code Enforcement Departments and the Windham Economic Development Corporation have streamlined the permitting process so Windham’s restaurants and retailers can adjust their customer service areas to better meet the new regulations.    

On Tuesday, May 26th, The Windham Town Council approved the process, as well as waived any fees related to these temporary permits for restaurants and retailers.  The approval for these temporary permits will be in force through October 31, 2020.

If there is a need for restaurants to expand their seating footprint outside of the current permitted footprint to meet social distancing requirements, without expanding the current permitted seating capacity, they would only need to apply for a temporary Change of Use permit with the Code Enforcement Office.  The Windham Town Council has waived the $50.00 permit fee for this temporary Change of Use permit.  Please note that the restaurant may need to apply for an Extension to their current Maine Liquor License to allow for liquor sales in any new seating areas developed.  The Extension should be applied for through the Windham Town Clerk’s Office.

If there is a need for a retailer to add to their designated retail sales footprint outside of their building, to meet social distancing requirements, they will need to obtain a Retail Sales, Outdoor Temporary permit from the Code Enforcement Office.  The Windham Town Council has waived the $100.00 permit fee for this Retail Sales, Outdoor Temporary permit. 

Below are the steps for approval for restaurants:

  • Discuss your plans with the property owner and get permission
  • Sketch a dimensional Plot Plan clearly delineated with additional seating footprint area(s)
  • Total number of seats is limited to existing permitted total
  • Submit a temporary Change of Use application to the Windham Code Enforcement Office
  • The Windham Town Council has waived fees for this temporary Change of Use permit
  • Code Enforcement Office will review the application and provide approvals as appropriate
  • The permit will be in force through October 31, 2020

Below are the steps for approval for retail stores:

  • Discuss your plans with the property owner.and get permission

  • Submit a Retail Sales, Outdoor Temporary application to the Windham Code Enforcement Office
  • The Windham Town Council has waived fees for this Retail Sales, Outdoor Temporary permit
  • Code Enforcement Office will review the application and provide approvals as appropriate
  • The permit will be in force through October 31, 2020

W.E.D.C. Covid-19 Disaster Business Loan Fund

Application process:


The following information will be required for consideration of a loan request:

a)     Loan application
b)    Business Continuation Plan or Business Restart Plan consisting of the  following:
               1.  Summary of actual impact of the disaster on the business.
        2.  Plan for use of loan funds.
                3.  The plan should identify what steps the owner(s) has taken or will be taking t
               mitigate the effects of the economic hardships faced by the business. 
               For 
example, which Federal and/or State disaster relief programs have been  
              applied for and what specific measures that have been taken to reduce major
              expenses temporarily and/or put payment obligations on temporary
              forbearance.
c)    Description of the business’ employee profile with brief explanations for changes
       in January 2020, February 2020, March 2020, currently, and for the next six
       months.
d)    Copy of Profit and Loss statements for the months of January 2020, February
        2020, March 2020, April 2020 (if available).
e)    Six-month cash flow projection assuming restart June 1, 2020.
f)     Copy of Articles of Incorporation, Partnership Agreements, Operating
       Agreements, stock ledgers, tax returns or other documentation that shows
       business ownership  structure and percentage ownership for each Guarantor.

Application and Approval Process:

Submit a Loan Application and supporting materials to the WEDC, 8 School Road, Windham, Maine, 04062. The application will be reviewed to determine appropriateness for the WEDC Business Continuation Loan or the Business Restart Loan programs.

The WEDC Business Loan Fund Loan Committee reviews and approves loan requests.

The application will be reviewed by the WEDC Executive Director for completeness and initial eligibility determination. The applicant’s name and business address will be forwarded to the Town of Windham for review of tax standing.

The application will be underwritten through the WEDC Executive Director. Upon completion of underwriting, the WEDC Executive Director will forward the application to the WEDC Business Loan Fund Loan Committee with recommendations.

The Loan Committee shall review the application as presented by the WEDC Executive Director, deliberate its merits, and may vote to approve, approve with conditions, deny, or to return the application to the WEDC Executive Director and the applicant with instructions. 

The Loan Committee shall have the authority by majority vote to enter into executive session to discuss confidential information.  All application information shall remain confidential to the fullest extent of the law.  All votes of the Loan Committee shall be taken in open session. A positive vote of at least three (3) members of the Committee is required for approval of the loan application.  The WEDC Business Loan Fund reserves the right to accept or reject any loan application.
